Public Notice
The Florida Public Safety Act gives law enforcement the authority to publicly notify citizens of sexual offenders and sexual predators living within a community. Misuse of public records information relating to a sexual offender or sexual predator is a first degree misdemeanor. Citizen abuse of the information to threaten, intimidate or harass sexual offenders or sexual predators could potentially end our current ability to release this important information to the public. This notification is not intended to increase fear; rather it is our belief that an informed public is a safer public.
The Aventura Police Department follows the guidelines of the Florida Department of Law Enforcement (FLDE). The agency will post all sexual offenders and sexual predators in the lobby entrance of the Police Department and the City website.

Who is a Sexual Offender?
The designation of a person as a sexual offender is not a sentence or a punishment, but is simply the status of the offender which is the result of a conviction for having committed certain crimes. There are several ways a person can be qualified and designated as a “sexual offender” in the State of Florida. A person qualifies if the are convicted of committing, attempting, soliciting or conspiring to commit any specified enumerated sexual crime AND are in custody or control of the Florida Department of Corrections, or in the custody of a private correctional facility, on or after October 1 st, 1997 as a result of the above convictions OR by another sexual offender designation in another state or jurisdiction and as a result of such designation, are subjected to registration or community or public notification, or both or would be if a resident of that state or jurisdiction.
Who is a Sexual Predator?
A sexual predator is a person who was convicted of a serious sexual crime against a minor (under 18 years of age) or an adult, AND who was declared to be a "sexual predator" by the court AND has previously been convicted of certain enumerated felony sex offenses within 10 years. Because these sexual predators are no longer incarcerated, the law, FSS 775.21, requires they initially register with either the Florida Department of Law Enforcement (FDLE) or with the local Sheriff's Office.
A person classified as a sexual predator is so classified for life, unless his/her civil rights were restored, OR conviction was overturned, OR received a full pardon.
What is the difference between Sex Offenders and Sexual Predators?
Under Florida law, not all “sex offenders” are “sexual predators”. A court must make a specific finding that an offender is a predator before that offender can be officially designated as a sexual predator and be subject to Florida’s sexual predator registration and notification requirements. All sexual offenders and sexual predators must register with the state.
